HOA Board

 The HOA board is a group of volunteer neighbors that are elected for two-year terms, unless there has been a resignation. In odd years, the membership votes three board members in and in even numbered years the membership elects four board members annually at the Board meeting (typically in March of each year, but held in February of 2023).  The HOA board acts on behalf of the homeowners in accordance with the HOA covenants, as amended.

 

The HOA seeks to maintain a diverse board, with fresh points of view, including new homeowners joining the HOA. Please ask about joining as a volunteer board member or sub-committee member.

Board sub-committees

Committees of the HOA Board are made up of non-Board member and Board members, and report to the Board, along with making recommendations. Certain committees, such as the Design Committee, are delegated with the authority to review plans and make recommendations to the Board President.

Design Committees

The Design Committees review property and building additions or changes in accordance with the covenants. There are separate design committees for Archer and HRRanch. The most frequent requests are around the addition of out structures (a maximum of three are allowed), for example garages or barns.

Trails Committee

The Trails Committee reviews the usage and maintenance of the HOA owned trails and property. The Trails Committee met a number of times in 2021 but has yet to meet in 2022.

Archer’s Road Committee

Archer’s Road Committee oversees the road maintenance for Archer.

HOA Board duties: The Board organizes the annual HOA meeting, oversees the maintenance of HOA owned properties, including weed control, along with roads in Archer and HR Ranch 3 collects the HOA fees, manages the HOA funds, enforces HOA covenants of behalf of the HOA homeowners, implements amendments proposed and approved by 2/3 of the homeowners, reviews variances approved by 2/3 of the homeowners, among other ancillary duties on behalf of the fellow HOA homeowners.

Covenants:

The Board fields a number of requests to amend the covenants. The Board does not have the power to amend the covenants or veto a properly approved covenant amendment. The covenants provide an avenue for the homeowners to amend the covenants with 2/3 approval. The Board does not have a final decision on amendments outside of being fellow homeowners.

The homeowners have been incredibly supportive of the HOA and its board. However, we have received communication that is not considered to be appropriate. We request that homeowners communicate with the Board with the same level of respect that they expect, even in the face of contentious or emotional issues that arise.

Covenant Violations

The covenants were designed to help protect and maintain the properties in our neighborhood in a consistent manner. As to be expected, the homeowners frequently have different preferences and opposing views on the covenants. As fellow neighbors, we volunteered to assist in ensuring that the covenants are being followed for the enjoyment of all on behalf of the HOA. Steps that the Board follows to inform homeowners and follow up.

  1. Identifies covenant violations.

  2. Mails notifications to the homeowners to notify them of the violation and the timeline to resolve.

  3. Sends a follow up notification.

  4. Instructs the HOA legal counsel to send a formal letter.

  5. Follows the covenant guidelines, including placing a lien on the property if fees are owed and an legal injunction if all other measures fail.

Amendments

Amendments apply to all of the properties in the HOA. The Board oversees both the HR Ranch and Archer HOAs and they each have different covenants. The process for the homeowners to approve amendments is as follows:

  1. The homeowner(s) write up a proposed amendment. The homeowner may use their own resources to ensure the amendment is written properly to accomplish the intended purpose. It is recommended that the proposed amendment is written carefully.

  2. The homeowner(s) circulate the proposed amendment for a vote of two thirds of the membership among the 177 voting tracts and sites between HRRanch and Archer.  118 affirmative votes must be received for an amendment to be adopted across both HRRanch and Archer. For HRRanch specific amendments, an affirmative vote of 86 tracts is required. This is typically done via house-to-house distribution.

  3. The Board receives the proposed amendment and counts the votes.

  4. The Board circulates the amendment with HOA counsel to coordinate filing the amendment with the County to make it official.

Variances

Variances are requests by homeowners to adjust covenants that are specific to certain tracts or sites (not every tract or site) and owners. These require a 2/3 vote by the HOA homeowners and a majority affirmative vote by the Board. The process is otherwise the same as an amendment.
