Standard Operating Procedures - Covenant Violations

Purpose: Provide a transparent and consistent procedure for enforcement of covenant violations.  

1. When the Board becomes aware of an alleged covenant violation, either through notification by a  Resident or through observation by the Board, the Board will review the alleged violation and determine whether to pursue the matter. If the Board elects to pursue the complaint, the Board will issue a certified letter and/or send an email to the noncompliant Resident requesting a signed response from the alleged violator to confirm or deny the alleged violation within 2 weeks.

  • Full Public Disclosure:

    • The Board will acknowledge by emailing the sender confirmation that the Violation Notification form has been received and whether the Board has determined to pursue the complaint.

    • If the Board decides to pursue the complaint.  The Violation Notification form submitted will accompany the certified letter or email to the noncompliant Resident.

    • Quarterly, the Board shall post on the HOA website a list of the covenant violation notifications received listing the person making the complaint, and the actions taken by the Board.

2. Upon acknowledgement or confirmation of a violation, the violator will have 30-days to   correct the violation or propose to the Board a resolution plan for review and approval. Unless    the Board  deems the violation requires immediate action, a shorter response period may be set.  

3. If the Board does not approve a resolution plan and the violation is not corrected, the Board will have their legal representative issue a certified letter of violation. The noncompliant Resident has  2-weeks from legal notification to correct violation.  

4. If violation is not corrected, the Board may pursue formal enforcement actions which will include  legal counsel filing suit against the resident in violation of the covenant(s).  

5. The covenants and subsequent revisions as filed with the Clerk of Laramie County as Declaration  of Covenants, Conditions and Restrictions for 1st, 2nd and 3rd Filings of HR Ranch and Archer  Ranch, Cheyenne, Wyoming are the covenants as mentioned above.
